The following terms apply to every Kinsman Construction LLC estimate. Acceptance requires customer signature through DocuSign. Viewing an estimate alone does not constitute acceptance. Terms Version: 2026-09-11 (September 2026).

This document is an estimate of proposed work and pricing, not a final invoice. It becomes a binding agreement only when accepted in writing by the customer (including electronic acceptance) and confirmed by Kinsman Construction LLC.

Pricing is valid through the “Valid Until” date shown on the estimate, unless withdrawn earlier in writing. After that date, prices, availability, and schedule are subject to revision.

Work is limited to the labor, material, and allowance items listed on this estimate. Anything not expressly listed is excluded. Allowances (if any) are budgets for the stated purpose only; amounts above an allowance are billed as extras.

Unless listed, this estimate excludes structural engineering, permits/fees paid to jurisdictions, hazardous-material abatement, electrical/plumbing/HVAC trades beyond stated paint or finish scopes, furniture/fixture moves, overnight security, and repair of pre-existing conditions discovered after work begins.

Pricing assumes reasonable access and conditions as described at the time of estimating. Concealed or unforeseen conditions (substrate damage, undocumented utilities, moisture, asbestos, structural issues, etc.) may require a written change order before work continues.

Changes to scope, materials, finishes, schedule, or site conditions must be approved in a written change order (including email/text confirmation) before the additional work is performed. Verbal requests alone do not authorize extras.

Customer selections that differ from assumed grades, colors, or brands may change price and lead time. Material shortages or manufacturer discontinuations may require approved substitutions of equal quality.

Start and completion dates are targets, not guarantees. Delays caused by customer decisions, other trades, site access, weather, supply chain, or force majeure may extend the schedule without penalty to Kinsman Construction LLC.

Payment terms will be stated on the invoice or project agreement. Typical commercial work may require a deposit and progress draws. Work may be paused if invoices become past due. Final payment is due upon substantial completion unless otherwise agreed in writing. Approved change orders and allowance overages are billed separately.

Customer (or site contact) will provide timely access, decisions, and a reasonably clear work area; protect or remove valuables; and ensure pets/occupants are coordinated so crews can work safely. Delays from lack of access or decisions may affect schedule and cost.

Kinsman Construction LLC will perform work in a professional manner consistent with industry standards for the stated scope. Manufacturer warranties apply to covered products. Warranty excludes damage from misuse, lack of maintenance, other trades, moisture, structural movement, or work outside this estimate.

Crews will maintain a clean, professional jobsite appropriate to the work. Customer agrees not to interfere with active work areas and to follow any posted safety instructions while work is underway.

Except as required by law, Kinsman Construction LLC’s liability under this estimate is limited to the amount paid for the specific work giving rise to the claim. Consequential, incidental, and lost-profit damages are excluded to the fullest extent permitted by Missouri law.

These terms are governed by the laws of the State of Missouri. Venue for disputes is in the courts serving Greene County, Missouri, unless the parties agree otherwise in writing.

Customer signature is required through DocuSign. Viewing this estimate or clicking a non-signature acknowledgment does not constitute acceptance. Execution is complete only when DocuSign reports the envelope as completed.

These Terms of Use are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any disputes shall be resolved in courts located in Missouri.

We may update these terms from time to time. Estimate PDFs preserve the Terms Version that applied when the estimate was sent or signed. Continued use of the website after changes are posted constitutes acceptance of the revised website terms.
